The Court of Justice finds, first, that the takeover by a public authority of a Member State of staff employed by another public authority and entrusted with the supply to schools of auxiliary services such as maintenance and administrative assistance constitutes a transfer of an undertaking where that staff consists in a structured group of employees who are protected as workers by virtue of the domestic law of that Member State.
La Cour constate, tout d'abord, que la reprise, par une autorité publique d’un État membre, du personnel employé par une autre autorité publique et chargé de la fourniture, à des écoles, de services auxiliaires comprenant notamment des tâches de maintenance et d’assistance administrative, constitue un transfert d’entreprise, lorsque ce personnel est constitué d’un ensemble structuré d’employés qui sont protégés en tant que travailleurs en vertu du droit interne de cet État membre.
