In exercising their inspection rights and obligations as port States, Member States shall report to the Commission and to other Member States, and inform the flag State concerned, the discovery of the issue of valid certificates by organisations acting on behalf of a flag State to a ship which does not fulfil the relevant requirements of the international conventions, or of any failure of a ship carrying a valid class certificate and relating to items covered by that certificate.
Dans l'exercice de leurs droits et obligations d'inspection, en qualité d'État du port, les États membres signalent à la Commission et aux autres États membres, lorsqu'ils découvrent que des certificats valides ont été délivrés, par des organismes agissant pour le compte de l'État du pavillon, à un navire qui ne satisfait pas aux prescriptions pertinentes des conventions internationales ou lorsqu'ils constatent une insuffisance présentée par un navire porteur d'un certificat de classification en cours de validité et concernant des éléments couverts par ce certificat, et ils en informent l'État du pavillon concerné.
