A judge in a third Member State (C), where the accused actually resided, to whom the case was referred by the national customs authorities declared their action inadmissible on the specific ground that the certificate provided by the authorities of Member State A was insufficient for the purpose of proceedings in Member State C. This certificate confirmed, however, that the offence was punishable under the law of Member State A and referred to the penalties incurred by offenders in that State.
Le juge d'un troisième État membre (C), lieu de résidence de l'inculpé, saisi de l'affaire par les autorités douanières nationales, l'a déclarée irrecevable, notamment au motif que l'attestation fournie par les autorités de l'État membre A était insuffisante aux fins de poursuites dans l'État membre C.
