It follows that EU law precludes a judicial practice which makes the obligation for a national court to disapply any provision contrary to a fundamental right guaranteed by the Charter conditional upon that infringement being clear from the text of the Charter or the relevant case-law, since it withholds from the national court the power to assess fully, with, as the case may be, the cooperation of the Court of Justice, whether that provision is compatible with the Charter.
Il en résulte que le droit de l’Union s’oppose à une pratique judiciaire qui subordonne l’obligation, pour le juge national, de laisser inappliquée toute disposition contraire à un droit fondamental garanti par la Charte à la condition que cette contrariété ressorte clairement du texte de la Charte ou de la jurisprudence pertinente, dès lors qu’elle refuse au juge national le pouvoir d’apprécier pleinement, avec, le cas échéant, la coopération de la Cour, la compatibilité de ladite disposition nationale avec la Charte.
