According to the German legislation sent to the Commission, the requirements deriving from Article 9 of the Framework Decision are basically covered by section 3 et seq. of the criminal code; where offences are not covered by section 6(7) of the criminal code (acts against internationally protected legal interests), the jurisdiction provisions contained in Article 9(1)(c) of the Framework Decision are not to be applied (decision in accordance with paragraph 2 and 3).

In the event of a failure of the negotiations pertaining to the signing, within the additional period that could be granted by the Court, of an agreement that would comply with the original Federal Court decision, the Government will suspend the application of the Contraventions Act in Ontario and will return to the summary conviction process of the Criminal Code for the prosecution of contraventions other than parking contraventions.

I understood Senator Doyle's question to be whether it is possible that, had this Contraventions Act been in place for the last four years, some Canadians who now have criminal records would not have such criminal records because the province may have chosen to go via the Contraventions Act as opposed to via the present Criminal Code.
