In a situation such as that at issue in the main proceedings, in which a tenderer intends to carry out a
public contract by having recourse exclusively to workers employed by a subcontractor established in a Member State other tha
n that to which the contracting authority belongs, Article 56 TFEU precludes the application of legislation of the Member State to which that contracting authority belongs which requires that subcontractor to
pay those workers a minimum wage ...[+++] fixed by that legislation.
Dans une situation telle que celle en cause au principal, dans laquelle un soumissionnaire entend exécuter un marché public en ayant recours exclusivement à des travailleurs occupés par un sous-traitant établi dans un État membre autre que celui dont relève le pouvoir adjudicateur, l’article 56 TFUE s’oppose à l’application d’une réglementation de l’État membre dont relève ce pouvoir adjudicateur obligeant ce sous-traitant à verser auxdits travailleurs un salaire minimal fixé par cette réglementation.
