A further clarification concerns the proof to be provided by third-country citizens who do not have the entry stamp on their travel document to demonstrate their legality: it seems more appropriate, from the legal point of view, to speak of ‘documentary proof’ rather than ‘any form of proof’ or ‘demonstrating by any means’ followed, in the Commission text, by a list of possible justifications.

1. Where a Member State requires of its own nationals proof of good repute and proof of no previous bankruptcy, or proof of either of these, that State shall accept as sufficient evidence in respect of nationals of other Member States the production of an extract from the ‘judicial record’ or, failing this, of an equivalent document issued by a competent judicial or administrative authority in the home Member State or the Member State from which the foreign national comes showing that these requirements have been met.

1. The discovery of slight discrepancies between the statements made in the proof of origin and those made in the documents submitted to the customs office for the purpose of carrying out the formalities for importing the products shall not ipso facto render the proof of origin null and void if it is duly established that this document does correspond to the products submitted.
