(ii) where the gratuity, by reason of the death of the member to whom it was payable, becomes payable in whole or in part to a dependant, any overpayment that the Minister has found, with the concurrence of the Judge Advocate General, to have been made to such dependant as a result of wilful misrepresentation or fraud by the member or the dependant; and
(ii) si, par suite de décès du membre auquel elle était payable, la gratification devient exigible, en tout ou en partie, envers une personne à charge, tout plus-payé qui, d’après la constatation du Ministre, appuyée par le juge-avocat général, a été versé à une telle personne à charge par suite de fausse représentation ou de fraude volontaire par le membre ou la personne à sa charge; et
