(e) where no agreement is reached between Quebec and the band as
to the selection of replacement land within one hundred and twenty days after service of the expropriation notice (where the band has not contested the right to expropriate) or after the final judgment on the right to expropriate (where the band has contested that right), the compensation to the band shall be in the form of money instead of replacement

e) faute d’accord sur l’indemnité foncière entre le Québec et la bande dans les cent vingt jours suivant, selon le cas, la signification de l’avis ou le jugement définitif, l’indemnité foncière est remplacée par une indemnité pécuniaire, dont le montant doit être approuvé en assemblée extraordinaire ou par référendum, avec un taux de participation au vote d’au moins vingt-cinq pour cent. En cas de désaccord des parties sur le montant, c’est l’article 127 qui s’applique.
