Par la création d'une entreprise commune, ces trois entreprises sont convenues de collaborer au développement, à la conception, à la fabrication et à la vente de ces produits.Dans le communiqué à la presse annonçant sa décision (voir annexe 6), la Commission a indiqué que s'il est vrai que l'accord restreint le jeu de la concurrence, l'"investissement constitue un élément stratégique pour la Communauté dans la concurrence mondiale et la Commission s'est assurée que .les conditions de l'octroi d'une exemption individuelle à FPD étaient remplies; elle a ensuite clôturé le dossier en envoyant aux parties une lettre de compatibilité".
