La Cour juge que pour être en droit de refuser l’autorisation sur la base d’un motif tiré de l’existence d’un délai d’attente, cette institution se doit d’établir que le délai, découlant des objectifs de planification et de gestion de l’offre hospitalière, n’excède pas le délai acceptable compte tenu d’une évaluation médicale objective des besoins cliniques de l’intéressé au vu de son état pathologique, de ses antécédents, de l’évolution probable de sa maladie, du degré de sa douleur et/ou de la nature de son handicap au moment où l’autorisation est sollicitée.
