Moreover, the Commission has been informed of only one case of proceedings to secure the return of an object under Article 5 of the Directive, brought by Finland before the High Court in London ; in this case, however, the return was not effected by a court order, as an amicable settlement was eventually reached between the bona fide possessor and the Finnish authorities before the British court had handed down a judgment.
Par ailleurs, la Commission a été informée d'une seule action en restitution en vertu de l'article 5 de la directive, introduite par la Finlande devant la High Court de Londres, sans que toutefois la restitution ne se fasse par la voie juridictionnelle puisqu'une solution amiable entre le possesseur diligent et les autorités finlandaises a finalement été trouvée avant que la décision de la juridiction britannique ne soit rendue.
