It is expressly stipulated that this draft Directive must not have the effect of reducing the level of protection vis-à-vis the existing situation in each Member State. This principle, which was introduced by the Council in its common position on the protection of pregnant women, and which is espoused in the penultimate recital of the Charter, provides further assurance of the will to improve the working environment in the spirit of Article 118a of the Treaty.
La présence, dans ce projet de Directive, d'une clause de "non- régression" du niveau de protection par rapport à la situation existante dans chaque Etat membre - disposition introduite par le Conseil dans sa position commune sur "la protection des femmes enceintes", et conforme à l'avant-dernier considérant de la Charte, est une assurance supplémentaire de la volonté d'améliorer l'environnement de travail dans l'esprit de l'Article 118 A du Traité.
