Pursuant to its Article 1(3)(c), the Directive on the posting of workers notably applies to a temporary employment undertaking or placement agency which hires out a worker to a user undertaking established or operating in the territory of a Member State, provided there is an employment relationship between the temporary employment undertaking or placement agency and the worker during the period of posting.
Aux termes de son article 1er, paragraphe 3, point c), la directive concernant le détachement de travailleurs s’applique notamment à l’entreprise de travail intérimaire ou à l’entreprise qui met un travailleur à disposition, quand elle détache un travailleur à une entreprise utilisatrice établie ou exerçant son activité sur le territoire d’un État membre, pour autant qu’il existe une relation de travail entre l’entreprise de travail intérimaire ou l’entreprise qui met un travailleur à disposition et le travailleur pendant la période de détachement.
