The Board of Appeal further held that, if a shape is not sufficiently different from the usual shape of the goods, and potential purchasers do not therefore perceive it to represent the goods, then it is descriptive and falls within the scope of Article 7(1)(c), as would a word consisting simply of the name of the goods.
La chambre de recours a, en outre, estimé que, si la forme ne présente pas suffisamment de différence par rapport à la forme habituelle du produit et, donc, si l’acheteur potentiel ne la perçoit que comme représentant le produit, cette forme est alors descriptive et tombe dans le champ d’application de l’article 7, paragraphe 1, sous c), du règlement n° 40/94, de la même façon qu’un mot uniquement constitué par le nom du produit.
