The Commission therefore has taken the view that by not granting full personal deductions to resident individuals with foreign source income which under the relevant tax treaty is exempt with progression in Finland, the Finnish tax law provision contravenes the free movement of workers and self-employed persons guaranteed by Articles 39 and 43 of the EC Treaty and the corresponding provisions of the EEA Agreement.
La Commission estime, par conséquent, qu’en n’accordant pas de déductions personnelles intégrales aux résidents percevant des revenus de sources étrangères qui, en vertu du traité fiscal applicable, sont exonérés avec réserve de progressivité en Finlande, la disposition de la législation fiscale finlandaise est contraire à la libre circulation des travailleurs et des indépendants garantie par les articles 39 et 43 du traité CE et par les dispositions correspondantes de l’accord EEE.
