The Commission found that while immediately after the transaction, KNW will have a de facto monopoly for cable operations in its territory, the transaction itself does not create or strengthen a dominant position on the market for pay-television services in Germany, as KNW is simply taking over the position previously held by DT.
La Commission a estimé que si, immédiatement après l'opération, KNW détiendra un monopole de fait pour la télédistribution sur son territoire, l'opération en elle-même n'entraînera néanmoins pas la création ni le renforcement d'une position dominante sur le marché des services de télévision à péage en Allemagne, dans la mesure où KNW reprend simplement la position précédemment détenue par DT.
