Consequently, the Court held that prepayments of the kind at issue in the main proceedings whereby lump sums are paid for goods indicated in general terms in a list which may be altered at any time by agreement between the buyer and the seller and from which the buyer may possibly select articles, on the basis of an agreement which he may unilaterally rescind at any time, thereupon recovering the unused balance of the prepayments, do not fall within the scope of that derogation.
En conséquence, la Cour constate que des paiements anticipés, tels que ceux en cause au principal, d’une somme forfaitaire, versée pour des biens indiqués de manière générale dans une liste pouvant être modifiée à tout moment d’un commun accord par l’acheteur et le vendeur et à partir de laquelle l’acheteur pourra éventuellement choisir des articles, sur la base d’un accord qu’il peut à tout moment unilatéralement résilier en récupérant l’intégralité du paiement anticipé non utilisé, n’entrent pas dans le champ d’application de cette dérogation.
