Huit ans plus tard, compte tenu du fait que les progrès réalisés depuis l'arrêt sont insuffisants, la Commission renvoie l'affaire devant la Cour de justice. Conformément aux pratiques établies, elle propose d'infliger à la Grèce une astreinte journalière de 71 193 €, à compter de la date du second arrêt et jusqu'à ce qu'elle se conforme à l'arrêt, et une amende forfaitaire correspondant à 7 786 € par jour pour la période qui s'étend du premier arrêt au jour où cet État membre se sera conformé à l'arrêt, ou au jour du second arrêt de la Cour.
Eight years later, in view of insufficient progress since the ruling, the Commission is referring the case back to Court and, in line with established policy, suggesting a daily penalty payment of € 71 193 for each day after the second Court ruling until Greece complies with the judgment and a lump sum calculated on the basis of € 7 786 per day for the period between the first judgment and the day of compliance or the day of the second Court ruling.
