Le paragraphe 11(2) du projet de loi remplace le projet d’article 17.2 par une autre disposition interdisant à toute compagnie de chemin de fer d’exploiter ou d’entretenir un chemin de fer sous réglementation fédérale, notamment les installations et le matériel ferroviaires, et à toute compagnie de chemin de fer locale d’exploiter du matériel ferroviaire sur un tel chemin de fer, en contravention avec un CECF et, sauf si la compagnie bénéficie de l’exemption prévue aux articles 22 ou 22.1, en contravention avec les règlements et les règles établies sous le régime des articles 19 ou 20 qui lui sont applicables.
Clause 11(2) replaces proposed section 17.2 with another provision prohibiting a railway company from operating or maintaining a federally regulated railway, including any railway work or railway equipment, and a local railway company from operating railway equipment on such a railway, except in accordance with an ROC and – except to the extent that the company is exempt from their application under section 22 or 22.1 – with the regulations and with the rules made under sections 19 and 20 that apply to the company.
