Néanmoins, une telle résiliation n'est pas valable en droit, dès lors qu'elle vise à résilier un accord vertical avec un distributeur à cause de pratiques qui ne peuvent faire l'objet de restriction dans le cadre du présent règlement, en particulier les pratiques dont la restriction conduit à la non-application de l'exemption soit à la totalité de l'accord vertical, aux termes de l'article 4, soit à la restriction en cause, aux termes de l'article 5.
Such a notice of termination is, however, not legally valid if it is designed to end a vertical agreement with a distributor because of practices which may not be restricted under this regulation, in particular those practices, restriction of which results in the misapplication of the exemption either to the vertical agreement as a whole, in accordance with Article 4, or to the restriction in question, in accordance with Article 5.
