A new scientific committee, the pharmacovigilance risk assessment committee, is created within the European Medicines Agency (EMEA), and will advise the EMEA's Committee for medicinal products for human use, which remains responsible for issuing an opinion, on the risk-benefit assessment of centrally-authorised medicinal products for human use.

If a Member State raises important new questions of scientific or technical nature the Commission can refer the application back to the Agency for further consideration or convene a meeting of the Standing Committee on Medicinal Products for Humans; the Committee delivers its opinion by qualified majority (see article 148 paragraph 2 of the treaty).
