Ainsi, la Commission invoque à tort la jurisprudence selon laquelle, en vertu de l’article 56, troisième alinéa, du statut de la Cour, d’une part, les institutions de l’Union ne doivent faire preuve d’aucun intérêt pour pouvoir former un pourvoi et, d’autre part, il n’appartient pas au juge de l’Union de contrôler les choix effectués à cet égard par ces institutions.
Thus, the Commission is wrong to rely on the case-law to the effect that, under the third paragraph of Article 56 of the Statute of the Court of Justice, on the one hand, the institutions of the European Union do not have to show interest in order to bring an appeal and, on the other, it is not for the European Union judicature to review the choices made in this regard by those institutions.
