(5) Pour renforcer la sécurité juridique des contrats de garantie financière, les États membres devraient faire en sorte de les soustraire à certaines dispositions de leur législation en matière d'insolvabilité, notamment celles qui pourraient faire obstacle à la réalisation de la garantie financière ou rendre incertaine la validité de techniques actuelles, telles que la compensation bilatérale avec déchéance du terme (netting by close-out) ou la constitution de garanties à titre complémentaire ou de remplacement.
(5) In order to improve the legal certainty of financial collateral arrangements, Member States should ensure that certain provisions of insolvency law do not apply to such arrangements, in particular, those that would inhibit the effective realisation of financial collateral or cast doubt on the validity of current techniques such as bilateral close-out netting, the provision of additional collateral in the form of top-up collateral and substitution of collateral.
