As regards the observance of international human rights law, the human rights institutions need to be brought fully in line with the UN principles.

The Parties shall cooperate on all questions relevant to the establishment or reinforcement of democratic institutions, including those required in order to strengthen the rule of law, and the protection of human rights and fundamental freedoms according to international law and OSCE principles.

6. This Regulation shall be without prejudice to rights of public access to documents held by the institutions which might follow from instruments of international law or acts of the institutions implementing them.

If the existence of an incompatibility was not established by the ECJ and the remaining Article 228 procedures were complied with, it must be assumed that the institutions of the Community and the Member States are still bound because obtaining an opinion is not mandatory.
