À cet égard, le Tribunal a par exemple jugé, dans son arrêt dans l'affaire Deutsche Bahn/Commission, que la mise en œuvre, par l'Allemagne, d'une obligation claire et précise de ne pas soumettre le carburant fourni en vue d'une utilisation pour la navigation aérienne commerciale à l'accise harmonisée en vertu de la directive 92/81/CEE du Conseil (15), constituait une transposition de cette obligation en droit national, qui n'était donc pas imputable à l'État allemand, mais qui émanait d'un acte législatif de l'Union (16).
In this regard, the General Court held, for example, in Deutsche Bahn v Commission that the implementation by Germany of a clear and precise obligation not to levy the harmonised excise duty on fuel used for the purpose of commercial air navigation laid down in Directive 92/81 (15) was, as an implementation of this obligation into national law, not imputable to Germany but in fact stemmed from an act of the Union legislature (16).
