Cette modification donne suite aux préoccupations grandissantes du public, et même de certains parlementaires, relativement à l’apparence de conflit entre la politique du Conseil du Trésor, qui interdit le paiement d’honoraires conditionnels dans certains cas(35), et la LEL, qui oblige les lobbyistes à déclarer ce type d’arrangement (al. 5(2)g))(36). Par conséquent, le paragraphe 69(2) du projet de loi modifie l’alinéa 5(2)g) de la LEL pour obliger les lobbyistes à indiquer dans le formulaire de déclaration que leur engagement ne prévoit pas d’honoraires conditionnels.
The contingency fee ban will address concerns that have been increasingly raised by the public and also some parliamentarians about the apparent conflict between Treasury Board policy prohibiting contingency fees in certain instances(35) and the requirement in the LRA that lobbyists report such arrangements (section 5(2)(g)) (36) Thus, section 5(2)(g) of the LRA will also be amended by clause 69(2) of Bill C-2 to require lobbyists to indicate in their registration forms that they are not operating on a contingency fee basis.
