À cet égard, il ne peut pas y avoir de lien étroit entre, d’une part, une demande d’assistance au titre de l’article 24 du statut dénonçant un harcèlement moral de la part de la hiérarchie de l’intéressé et, d’autre part, une décision implicite de rejet de cette demande et de la demande d’indemnité pour manquements par l’institution concernée à son devoir de sollicitude.
In that regard, there cannot be a close link between, on the one hand, a request for assistance under Article 24 of the Staff Regulations complaining of psychological harassment on the part of the superiors of the person concerned and, on the other, an implied decision rejecting that request and the claim for compensation for the breach by the institution concerned of its duty to have regard to the welfare of its officials.
