(4) By Decision 2001/792/EC, Euratom, a Community mechanism to facilitate reinforced cooperation in civil protection assistance interventions (hereinafter: the mechanism) was established, which also takes into account the special needs in terms of assistance and aid delivery in the isolated, outermost and other regions or islands of the Community.

Since the objective of the action to be taken, namely the maintenance of a high level of security in the supply of crude oil within the Community, by means of reliable and transparent arrangements based on solidarity between Member States, while complying with the rules of the internal market and the competition rules, may be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

It shall act in support of the Community framework for cooperation in the field of accidental or deliberate marine pollution established by Decision No 2850/2000/EC of the European Parliament and of the Council of 20 December 2000 setting up a Community framework for cooperation in the field of accidental or deliberate marine pollution(8) and of the Community mechanism in the field of civil protection assistance interventions established by Council Decision 2001/792/EC, Euratom of 23 October 2001 establishing a Community mechanism to facilitate reinforced cooperation in civil protection assistance interventions(9)".

In 2000, several heads of state and foreign ministers reinvigorated these constitutional deliberations, highlighting once more the need to make the Union's decision mechanisms more effective and transparent and to emphasise the several elements of constitutional quality of the Treaties.

(7) Whereas, in accordance with the principle of subsidiarity and in accordance with the principle of proportionality as stipulated in Article 3b of the Treaty, the objective of maintaining a high level of security of oil supply in the Community through reliable and transparent mechanisms based on solidarity amongst Member States and, at the same time, complying with the rules of the internal market and competition, can be carried out more adequately at the level of the Community; whereas this Directive does not exceed what is necessary to achieve this objective;

5. Notes with satisfaction the considerable progress made in particular with regard to transparency, strengthening Community monitoring mechanisms and legislative initiatives which have been proposed or are in the process of adoption on public health and consumer protection;
