La référence à un indice constituant un étalon représentatif, contenue à l’article 22 bis, paragraphe 1, deuxième tiret, de la directive 85/611/CEE, s’entend comme une référence à un indice dont le fournisseur utilise une méthode reconnue qui n’aboutit pas, en règle générale, à exclure un grand émetteur du marché auquel l’indice se réfère.
3. The reference in the second indent of Article 22a(1) of Directive 85/611/EEC to an index which represents an adequate benchmark shall be understood as a reference to an index whose provider uses a recognised methodology which generally does not result in the exclusion of a major issuer of the market to which it refers.
