The implementing rules which may be necessary pursuant to this paragraph, and in particular measures to ensure that goods declared for export under a preferential arrangement are not in fact exported under a non-preferential arrangement or vice versa, shall be adopted in accordance with the same procedure".

The report also examines the numerous issues linked with the tariff classification, value and origin – both preferential and non-preferential – of goods, in the hope that the Commission will heed the demands of the industrial sectors concerned.

The rules concerning, inter alia, the 'factors on the basis of which import or export duties and other measures prescribed in respect of trade in goods are applied' (tariff classification, preferential and non-preferential origin, customs value), dealt with in Chapter 2 of the proposal, are such as to have a considerable impact on the scope of the regulation and, therefore, on the practical consequences of the measures adopted under this policy.

Bilateral accumulation involves two partners and allows a trader in country A to use materials originating in country B as if they originated in A, and vice versa, with the origin criteria applying only to non-originating goods; it is therefore sufficient for the operation carried out in A to have been "more than minimal" to obtain A origin for the goods; this form of accumulation is applied in all the bilateral agreements concluded by the Community and in its autonomous preferential arrangements (Generalised preference schemes, separate measures for the Western Balkans, Overseas Countries and Territories (OCT) procedure).
