The European Commission, using the procedure for controlling the respect of the principle of subsidiarity provided by Article 5 of the Treaty on European Union (TEU) and Protocol 2 to the Treaty of Lisbon, must draw national parliaments' attention to initiatives taken on the basis of Article 352 TFEU.

For the moment the Commission's plan with this communication is to prompt a change of enforcement culture. Merely enforcing the law against infringements is not enough; there is a need for prevention also. But cooperation will not release the Commission as guardian of the Treaties from its duty to remind the Member States of their commitments and to seek the best instruments at all times.

Stresses that European initiatives in the field of cohesion and structural policy need to be better coordinated so as not to jeopardise the coherence of regional policy; calls therefore for strengthened coordination in the Commission between DG REGIO, which is responsible for cohesion and structural policy, and the DGs responsible for the relevant sector-specific initiatives; calls, in view of the Lisbon Treaty’s strengthening of the rights of regional and local authorities, for these authorities to be more closely involved in the development of policy at Commission level, in order to enhance project responsibility among project promot ...[+++]ers; also calls, however, for more control of results by the Commission on the spot, so as to improve evaluation both of the efficiency of project structures and of the effectiveness of measures in terms of the objective they seek to achieve;

3. The Council shall decide, by qualified majority and acting on an initiative presented pursuant to paragraph 1 or 2, on the basis of Article 34(2) (c) of the Treaty, whether to submit the new psychoactive substance to control measures.
