À cet égard, elle constate que, puisqu’il est constant que le pollen en cause a perdu toute aptitude concrète et individuelle à la reproduction, il appartient à la juridiction de renvoi de vérifier si ce pollen est capable, par ailleurs, de « transférer du matériel génétique », en prenant dûment en compte les données scientifiques disponibles et en considérant toute forme de transfert de matériel génétique scientifiquement avérée.
It holds in that regard that, since it is common ground that the pollen in question has lost all specific and individual ability to reproduce, it is for the referring court to determine whether that pollen is otherwise capable of ‘transferring genetic material’, taking due account of the scientific data available and considering all forms of scientifically-established transfer of genetic material.
