La présente décision apporte une précision importante concernant la notion d'aide d'État au sens du droit de l'UE car elle confirme que la viabilisation de terrains par une autorité locale est une mission de service public et que cette appréciation n’a pas changé après les arrêts rendus par les juridictions de l'UE dans l'affaire Leipzig/Halle (affaires jointes T-443/08 et T-455/08) et affaire C-288/11 P).

La conséquence est que le terrain viabilisé d'un quartier urbain ou d'une petite collectivité rurale qui possède déjà ces services perd son avantage concurrentiel.
