Par son premier moyen, la requérante a
llègue que, dans le cadre de son appréciation du caractère distinctif des marques en cause, le Tribunal n’a pas analysé, comme il l’aurait dû, l’impression d’ensemble produite par chacune d’elle, mais a adopté, au point 36 de l’arrêt attaqué, une approche erronée, consistant à décomposer lesdites marques en constatant qu’«elles se caractérisent
par le fait d’être cylindriques» et que, pour quatre
d’entre elles, «le corps cylindriq ...[+++]ue des lampes de poche s’évase à l’extrémité où se situe l’ampoule».
By its first ground of appeal, the appellant claims that, in assessing the distinctiveness of the marks in question, the Court of First Instance failed to consider, as it was required to do, the overall impression given by each of them, but, at paragraph 36 of the contested judgment, adopted the wrong approach by separating the marks into their component parts, holding that ‘it is a feature of the shapes that they are cylindrical’ and that, in four of them, ‘the torches’ cylindrical shape opens out where the bulb is’.
