considérant que, en exerçant ce pouvoir, la Commission prendra en considération non seulement le risque d'élimination de la concurrence sur une partie substantielle du marché concerné et les avantages que ces accords pourraient comporter pour les preneurs d'assurances, mais également le risque qu'entraîneraient, pour les preneurs d'assurances, la prolifération de clauses restrictives et l'utilisation de sociétés de complaisance;
Whereas, in the exercise of such powers, the Commission will take account not only of the risk of competition being eliminated in a substantial part of the relevant market and of any benefit that might be conferred on policyholders resulting from the agreements, but also of the risk which the proliferation of restrictive clauses and the operation of accommodation companies would entail for policyholders;
