En troisième lieu, à l’égard des crédits d’impôt de 45 % du montant des investissements, la Cour confirme, à l’instar du Tribunal, que la Commission n’a pas enfreint le principe de proportionnalité lorsqu’elle a estimé, dans sa décision, que l’obligation de récupération à la charge des autorités espagnoles devait s’appliquer à l’intégralité des aides octroyées et ne devait pas être limitée aux montants excédant les plafonds fixés pour les aides à finalité régionale.
Thirdly, with regard to the 45% tax credits on investments, the Court confirms, as did the General Court, that the Commission did not infringe the principle of proportionality when it found, in its decision, that the Spanish authorities’ obligation of recovery was to apply to the entirety of the aid granted and was not to be restricted to amounts exceeding the ceilings fixed for regional aid.
