L'approbation d'une décision de dérogation par la Commission perd effet deux ans après son adoption si la construction de l'infrastructure n'a pas encore commencé, et après cinq ans à compter de son adoption si l'infrastructure n'est pas devenue opérationnelle, sauf si la Commission décide qu'un retard est dû à des obstacles dirimants, hors du contrôle de la personne bénéficiant de la dérogation.
