Calls on the Member States to implement rules establishing paid maternity/paternity leave following the birth of a child and to promote the use of the right to parental leave shared equitably between women and men; urges the Member States, to this end, to combat the economic, social and cultural prejudices associated with the right of parental leave for men; calls on the Commission to revise Council Directive 96/34/EC of 3 June 1996 on the framework agreement on parental leave concluded by UNICE, CEEP and the ETUC ; considers that parental leave, with a simultaneous guarantee of job retention, should be taken up by both fathers an ...[+++]d mothers; advocates a system of incentives which will encourage partners to share parental leave, and recompense for the costs associated with bringing up children; calls on the Commission to consult both sides of industry on possible changes to the reforms concerning parental leave which were introduced in 1996, the purpose of which might be to extend the minimum period of three months to six;

Member States and/or social partners may, in particular: - decide whether parental leave is granted on a full-time or part-time basis, in a fragmented way or in the form of a time-credit system; - make entitlement to parental leave subject to a period of work qualification and/or a length of service qualification which will not exceed one year; - adjust conditions of access and detailed rules for applying parental leave to the special circumstances of adoption; - establish notice periods to be given by the worker to the employer, specifying the beginning and the end of the period of leave; - define the circumstances in which an emplo ...[+++]yer is allowed to postpone the granting of parental leave for justifiable reasons related to the operation of the undertaking; - authorize special arrangements to meet the operational and organizational requirements of small undertakings.

To this end: - Member States and/or social partners must take the necessary steps to protect workers against dismissal on the grounds of an application for, or taking of, parental leave; - at the end of parental leave, workers have the right to return to the same job or, if that is not possible, to an equivalent or similar job consistent with their employment contract or employment relationship; - rights acquired or in the process of being acquired by a worker on the date on which parental leave begins will be maintained as they stand until the end of parental leave.
