Est assimilé à des marchandises visées au paragraphe 2, point a), tout moule ou matrice qui est spécifiquement destiné ou adapté à la fabrication d'une marque contrefaite ou d'une marchandise portant une telle marque, à la fabrication d'une marchandise portant atteinte à un brevet ou à un certificat ou à la fabrication d'une marchandise pirate, à condition que l'utilisation de ces moules ou matrices porte atteinte aux droits du titulaire du droit selon la législation communautaire ou celle de l'État membre dans lequel la demande d'intervention des autorités douanières est faite.
3. Any mould or matrix which is specifically designed or adapted for the manufacture of a counterfeit trade mark or of goods bearing such a trade mark, for the manufacture of goods infringing a patent or a certificate or for the manufacture of pirated goods shall be treated as goods referred to in paragraph 2(a), provided that the use of such moulds or matrices infringes the rights of the holder of the right in question under Community law or the law of the Member State in which the application for action by the customs authorities is made.
