By 26 July 2017, the Polish Parliament had adopted four judicial reform laws; two of the laws had been signed into force by the President, and two of the laws were vetoed by the President and subject to further legislative discussions.

In addition, the Commission noted that the Sejm (Polish parliament) approved on 22 December 2015 a law amending the law on the Constitutional Tribunal, which concerns the functioning of the Tribunal as well as the independence of its judges.

The College of Commissioners decided on 26 July 2017 to launch this infringement procedure as soon as the Law on the Ordinary Courts Composition entered into force – it had already been adopted by the Polish Parliament and was awaiting publication in the Polish Official Journal.

Mr Tomczak has provided the Parliament with a legal opinion that analyses the matter of this apparent contradiction between the Polish Constitution and that Act at the time and concludes that a public court would need to deliver a ruling whether the actions of the Sejm and the Public Prosecutor were fault.
