Aux fins des poursuites concernant les infractions prévues à l'article 3, paragraphe 1, point a), à l'article 3, paragraphes 2 et 3, lorsqu'elles sont liées à l'article 3, paragraphe 1, point a), et l'incitation à commettre ces infractions, la participation à ces infractions, le fait de s’en rendre complice et la tentative de les commettre, l'établissement de la compétence ne devrait pas être subordonné à la condition que les actes en cause soient constitutifs d'une infraction à l'endroit où ils ont été commis.
For the purpose of prosecution of the offences laid down in point (a) of Article 3(1), Article 3(2) and (3), where they relate to point (a) of Article 3(1), as well as incitement, aiding and abetting, and attempt to commit those offences, jurisdiction should not be subordinated to the condition that the acts constitute an offence at the place where they were committed.
