(1) The Union's objective of offering its citizens an area of freedom, security and justice without internal frontiers, in which the free movement of persons is ensured (Article 3(2) of the Treaty on European Union(TEU)), should be achieved following the principle of solidarity and fair sharing of responsibility between Member States, inter alia, through common measures on the crossing of internal borders by persons and border control at external borders and the common visa policy as part of a multi-layer system, which is fair towards third-country nationals and aims at organising and facilitating regular migration and mobility, while fighting against organised crime and traff ...[+++]icking in human beings (Article 67(2) and (3), Article 71(1) and Article 80 of the Treaty on the Functioning of the European Union(TFEU));

W. whereas according to Article 67(3) TFEU the EU ‘shall endeavour to ensure a high level of security’; whereas the provisions of the Treaty (in particular Article 4(2) TEU, Article 72 TFEU and Article 73 TFEU) imply that the EU possesses certain competences on matters relating to the collective security of the Union; whereas the EU has competence in matters of internal security (Article 4(j) TFEU) and has exercised this competence by deciding on a number of legislative instruments and concluding international agreements (PNR, TFTP ...[+++]) aimed at fighting serious crime and terrorism, and by setting up an internal security strategy and agencies working in this field;

V. whereas according to Article 67(3) TFEU the EU ‘shall endeavour to ensure a high level of security’; whereas the provisions of the Treaty (in particular Article 4(2) TEU, Article 72 TFEU and Article 73 TFEU) imply that the EU possesses certain competences on matters relating to the collective external security of the Union; whereas the EU has competence in matters of internal security (Article 4(j) TFEU) and has exercised this competence by deciding on a number of legislative instruments and concluding international agreements ( ...[+++]PNR, TFTP) aimed at fighting serious crime and terrorism, and by setting up an internal security strategy and agencies working in this field;

2. The internal market shall comprise an area without internal frontiers in which the free movement of goods, persons, services and capital is ensured in accordance with the provisions of the Treaties.

In this connection, Parliament in the first place proposed extending the legal basis, inserting Article 153 of the Treaty (consumer protection) alongside Article 95 (internal market) as proposed by the Commission, with a view to furthering the objective of sufficient harmonisation in the interests of full consumer protection.

(6) In the light of Community objectives, of Articles 43 and 49 of the Treaty and of secondary Community law, these obstacles should be eliminated by coordinating certain national laws and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the internal market; by dealing only with certain specific matters which give rise to problems for the internal market, this Directive is fully consistent with the need to respect the principle of subsidiarity as set out in Article 5 of the Treaty.
