Following its investigations of the case, the Commission found: - that the freight rates charged by Hyundai undercut the normal freight rate by an average of 26 per cent; - that Hyundai's low rates were made possible by non-commercial advantages granted by the Korean government in the form of cargo reservation schemes and advantages given in the process of restructuring in the Korean shipping industry; - that major injury was caused to Community shipowners by Hyundai's low rates.
A l'issue de son enquête, la Commission a constaté : - que les taux de fret pratiqués par la compagnie Hyundai étaient, en moyenne, inférieurs de 26 % au taux de fret normal; - que les faibles taux proposés par cette compagnie ont été rendus possibles grâce à l'octroi par le gouvernement coréen d'avantages non commerciaux revêtant la forme d'accords en matière d'affrètement et d'avantages financiers en cas de restructuration; - qu'un préjudice important a été causé aux armateurs dela Communauté du fait de la faiblesse des taux pratiqués par la compagnie en question.
