L'affaire au principal avait été introduite par l’entreprise de transport Van Gend Loos qui, en important des marchandises d’Allemagne vers les Pays-Bas, devait s’acquitter des droits de douane qu’elle estimait contraires à la règle du traité CEE interdisant aux États membres d’augmenter les droits de douane dans leurs relations commerciales mutuelles.
The case in the main proceedings had been brought by the transport company Van Gend en Loos, which, when importing goods from Germany into the Netherlands, was required to pay customs duties which it considered to be contrary to the rules of the EEC Treaty prohibiting Member States from increasing customs duties in their mutual commercial dealings.
