L’article 4, paragraphe 2, de la directive 69/335/CEE du Conseil, du 17 juin 1969, concernant les impôts indirects frappant les rassemblements de capitaux, telle que modifiée par la directive 85/303/CEE du Conseil, du 10 juin 1985, doit être interprété en ce sens qu’il s’oppose à ce qu’un État membre réintroduise un droit d’apport sur l’emprunt que contracte une société de capitaux, si le créancier a droit à une quote-part des bénéfices de la société, lorsque cet État membre a préalablement renoncé à la perception de cet impôt.
Article 4(2) of Council Directive 69/335/EEC of 17 July 1969 concerning indirect taxes on the raising of capital, as amended by Council Directive 85/303/EEC of 10 June 1985, must be interpreted as precluding a Member State from reintroducing a capital duty on a loan taken up by a capital company, if the creditor is entitled to a share in the profits of the company, where that Member State has previously waived the levying of that tax.
