L’avocat général considère, que la réglementation polonaise, en ce qui concerne la détermination de la redevance perçue pour l’ensemble des prestations minimales et pour l’accès par le réseau aux infrastructures, conduit à la prise en compte de coûts qui ne sauraient manifestement être considérés comme étant directement imputables à l’exploitation du service ferroviaire.
The Advocate General takes the view that the Polish legislation, as regards the determination of the charges collected for all minimum services and for access by the network to infrastructures, results in the taking into consideration of costs which clearly cannot be regarded as being directly attributable to the operation of the railway service.
