If the administering State adopts the procedure o
f conversion of the penalty, that State (a) will be bound by the findings as to the facts in so far as they appear explicitly or implicitly in the judgment handed down in the sentencing State; (b) may, unless it has made a declaration to the contrary, convert a custo
dial penalty into a financial penalty if the penalty is less than or equal to a period of six months; and (c) may not aggravate the penal position of the sentenced person and will not be bound by any minimum penalty wh
ich its ow ...[+++]n law may provide for the offence or offences committed (Article 8(5)).
Si l'État d'exécution se décide pour la procédure de la conversion de la condamnation, cet État : a) est lié par la constatation des faits dans la mesure où ceux-ci figurent explicitement ou implicitement dans le jugement prononcé dans l'État de condamnation, b) peut, sauf déclaration contraire, convertir une peine privative de liberté en une peine pécuniaire lorsque la peine privative de liberté est d'une durée inférieure ou égale à six mois, et c) n'aggravera pas la situation pénale du condamné et ne sera pas lié par la peine minimale éventuellement prévue par sa propre législation pour la ou les infractions commises (art.8 (5)).
