peut le conduire à interpréter une ...[+++]règle nationale qui a été élaborée en ayant uniquement en vue une situation purement interne afin de l’appliquer à la situation transfrontalière en cause » .
The Court took the view that in the absence of provisions in Directive 76/308 on the consequences flowing when notification is made in a language other than the language of the requested Member State, ‘it is for the national court to apply national law while taking care to ensure the full effectiveness of Community law, a task which may lead it to interpret a national rule which has been drawn up with only a purely domestic situation in mind in order to apply it to the cross border situation at issue’ This was held to be subject only to the principles of equivalence and effectiveness
