En outre de la confiscation (à la suite d’une condamnation pénale) des produits et des instruments du crime, ou de la confiscation de leur valeur, l’article 4 autorise la confiscation des produits et des instruments du crime en cas de fuite ou de maladie de la personne concernée (lorsqu’il est impossible pour le suspect ou la personne poursuivie d’assister à la procédure pénale pendant un long laps de temps, empêchant la poursuite de la procédure dans des conditions normales et rendant impossible toute condamnation pénale).

In addition to the confiscation (following a criminal conviction) of proceeds and instrumentalities, or to the confiscation of their value, Article 4 allows the confiscation of the proceeds of crime and instrumentalities in cases of the flight or illness of the person concerned (when it is impossible for the suspect or accused person to attend the criminal proceedings for a longer period of time, meaning that the proceedings cannot continue under normal conditions and a criminal conviction is not possible).
